About The Position

The Oregon Department of Justice is seeking a probate attorney with experience in estates, trusts, guardianships and conservatorships to join the Civil Recovery Section of the Civil Enforcement Division. This position will be based in our Salem office, with opportunities for remote work and to work in our Portland office. The Civil Recovery Section attorneys represent the state in a wide range of probate and protective proceedings. They also represent all state agencies, boards, and commissions in a broad plaintiff-side civil litigation practice. The successful applicant will represent the state in a robust probate caseload, including estate cases (representing the state as a personal representative or a creditor), guardianships, conservatorships, trust litigation and Medicaid recovery actions. In addition to probate work, the successful applicant may also have the opportunity to work on other types of cases within the Civil Recovery Section, including claims arising from: Contracts. Damage to State Property. Fraud and Overpayments. Injunctive Relief. Real Property Disputes. Requirements

  • Active membership in good standing with the Oregon State Bar by the time of appointment.
  • At least three years of experience working as an attorney.
  • Possess superior analytical, advocacy, research, verbal communication, and writing skills.
  • Strong work ethic.
  • Collaborative work history with lawyers and non-lawyers.
  • Experience communicating directly with clients and managing client relationships.
  • Demonstrated commitment to diversity, equity, and an inclusive working environment where diverse individual experiences and perspectives are valued and supported.
  • Willingness and availability to travel throughout the state for court appearances, and other case-related work, including overnight stays away from home.

Nice To Haves

  • At least three (3) years of probate experience in Oregon, including experience representing personal representatives, creditors, guardians and/or conservators.
  • A working knowledge of Oregon estate, trust, guardianship and conservatorship law.
  • Probate litigation experience in Oregon state court.
  • Non-probate civil litigation in Oregon state or federal court is a plus.
  • Experience negotiating and resolving claims brought in civil actions, including multi-party settlement negotiations.
