About The Position

The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs’ and Criminal Justice Education and Training Standards Divisions. Recruitment Range: up to $115,937 IMPORTANT NOTE: This posting closes at 11:59:59 PM the night BEFORE the End Date listed. This Attorney IV position is the Lead Class Action and Complex Case Attorney for the Public Safety Section. The primary purpose of this Attorney IV position is to provide advanced professional litigation services, advanced legal and factual analysis, and thoughtful, meaningful legal advice to mid-level, senior, and executive managers of DAC. This position will also serve as advisor to other attorneys in the complex and class action litigation matters in the areas of corrections and civil rights law. This position also shares responsibility with several other attorney positions for providing all legal support services and such other duties as assigned.

Requirements

  • Licensed to practice law by the North Carolina State Bar and four years of progressively responsible professional legal experience.

Nice To Haves

  • 10 years of progressive civil litigation experience preferred.
  • Experience in NC Superior Court and Federal Courts preferred.
  • Jury trial experience preferred.
  • Extensive legal research and writing preferred.

Responsibilities

  • Represents Client Agency in Litigation. Conducts, independently or as a member of a litigation team, civil litigation in state administrative and trial courts, federal trial courts, and associated appellate courts in simple to complex case. Drafts pleadings, motions, orders, discovery requests and responses, and correspondence to comport with applicable law, agency rules and procedures, and the relevant rules of courts.
  • Researches and Investigates. Performs legal research manually and electronically from various sources, including Lexis-Nexis, Department of Justice and other law libraries, and assorted web-based sites
  • Advises Client Agency. Researches all relevant source material and legal precedents and provides legal advice to the client agency by means of formal and informal written opinions, training assistance, and policy review.
  • Criminal Appeals and Non-litigation Matters. Reviews trial transcripts and other documents, researches legal issues identified in the record of appeal and defendant’s appellate brief, and composes state’s appellate brief in response.
