Requirements

  • Juris Doctorate and active membership in good standing with the Massachusetts state bar.
  • 1+ years of litigation experience, within Subrogation, Insurance Defense, or related fields.
  • Successful completion of courses focused on legal research, writing, and analysis, demonstrating the ability to conduct thorough legal research and draft clear, well-structured legal documents.
  • Demonstrates strong time management skills, effectively balancing multiple tasks and deadlines.
  • Capable of organizing case files, managing legal documents, and understanding the discovery process.
  • Skilled in communicating with clients, preparing summaries, and maintaining records of interactions.
  • Well-versed in legal ethics and the standards of professional conduct.
  • Equipped with fundamental negotiation techniques and strategies for client interactions and settlement discussions.

Responsibilities

  • Represents insured individuals and the Company in the defense of bodily injury and property damage lawsuits, subrogation litigation, and uninsured/underinsured motorist cases.
  • Review new file assignments, all documentary evidence and approve initial pleadings, propounds discovery, and develop strategy
  • Manage all aspects of PIP/no-fault litigation from case inception through resolution including case evaluation, discovery, motion practice, arbitrations, mediations, and settlement negotiations.
  • Investigate and pursue subrogation litigation, as appropriate
  • Conduct settlements/dispositive proceedings (e.g., mediations, arbitrations, etc.)
  • Prepare and conduct court appearances (matter management conferences, hearings, status conferences, etc.)
  • Conduct depositions and examinations under oath and prepares summary documents
  • Prepares witnesses and clients for depositions, arbitrations, mediations, and trials including expert witnesses
  • Try and/or arbitrate cases and prepares motions and summary documents in liminie
  • Keep claim business partners updated on status (initial client contact, initial litigation plan, recurring contacts, strategy conferences, and pre-trial, etc.)
  • The Trial Attorney is required to travel to court as needed throughout the Metro Boston area, Worcester, the South Shore, Greater Boston, and other locations across Massachusetts in support of litigation responsibilities, including court appearances and related proceedings.
