About The Position

Senior Director, Associate General Counsel – Office of Special Counsel DaVita Kidney Care (“DaVita”) is a global leader in kidney-care services, dedicated to improving patients’ quality of life through clinical excellence and compassionate care. The Office of Special Counsel (OSC) is a division of the JLD. OSC is responsible for conducting privileged internal investigations and managing government investigations and litigation related to regulatory compliance issues, including the False Claims Act, Anti-Kickback Statute, Stark Law and Foreign Corrupt Practices Act. Role Overview: The Senior Director, Associate General Counsel, Office of Special Counsel (“OSC”), is the lead of the team comprised of attorneys, paralegals, and legal professionals. The Senior Director, Associate General Counsel will be responsible for the OSC litigation strategy, responding to government inquiries and interfacing with federal and state regulatory authorities conducting investigations as well as will oversee internal investigations. This attorney will also play a critical role in the larger “Litigation Alliance,” a group of teams focused on litigation efforts at DaVita.

Requirements

  • A minimum of ten years of general litigation experience, including experience managing all aspects of discovery, conducting motions practice, and driving settlement negotiations.
  • J.D. degree from an accredited law school.
  • Must be admitted to practice and in good standing in at least one jurisdiction in the United States.
  • Prior experience managing attorneys or paralegals.
  • Previous experience conducting internal investigations and representing clients in white collar investigations required.
  • Previous criminal or civil litigation experience.
  • Strong understanding of relevant health care compliance issues (i.e., AKS, Stark, HIPAA).

Nice To Haves

  • Previous experience with healthcare fraud and abuse prevention laws; Medicare and Medicaid billing and reimbursement requirements; and compliance issues for healthcare providers strongly preferred.
  • Previous prosecution or civil litigation experience with federal or state government preferred.
  • Experience clerking and/or working at a national or regional firm is a plus.
  • Team oriented with a focus on collaboration, support, and continuous improvement.
  • Can-do attitude and a drive to take on new responsibilities with the support of a tight-knit team.

Responsibilities

  • Manage and direct OSC team, collaborate with other legal lanes, internal business clients, and outside counsel to develop strategies to achieve DaVita’s business goals.
  • Develop and execute litigation strategy for a multi-state portfolio of matters.
  • Manage team, departmental metrics, and lead special projects.
  • Lead member of litigation team and manage outside counsel for civil and criminal fraud litigation matters, including outside counsel budgets and spend.
  • Handle and coordinate responses to inquiries from government regulators and investigators.
  • Provide advice to business partners and senior leaders on government investigations.
  • Conduct and manage internal investigations concerning potential fraud and abuse allegations.
  • Internal handling of legal disputes: analyzing legal claims; drafting demand letters; and negotiating and drafting settlement agreements.
  • Responsible for development of internal processes and reporting.
  • Support the business through general legal counseling on compliance related matters in a wide range of complex legal issues.
