About The Position

Boston Scientific, a leading producer of medical devices, is looking for a Senior Legal Director, Intellectual Property, to provide counsel and leadership on patent, copyright, trademark, trade secret and other technology portfolio matters with respect to its Endoscopy (Endo) and Urology (Uro) businesses. The position requires representation in company matters relating to intellectual property strategy, intellectual property law and other general legal advice where required.

Requirements

• J.D. admitted to a state bar in good standing.
• Registered Patent Attorney.
• 15+ years of IP law experience.
• 5+ years of people leadership experience.
• Strong academic and science/engineering background.

Nice To Haves

• Preference for medical device experience with 3-5 years of law firm experience.
• Preference of at least 5 years of experience drafting and prosecuting patent applications.
• Experience in drafting and analyzing opinions of counsel including freedom-to-operate, validity/invalidity, non-infringement/infringement, and patentability.
• Experience in mergers and acquisition due diligence.
• Experience in negotiating, drafting, reviewing, and analyzing IP technology agreements and all agreements with IP terms.
• Experience in arbitration, mediation, or other dispute resolution proceedings.
• Experience in litigating patent or IP technology matters in federal courts.
• Experience in patent office proceedings (IPR, PGRs interference, oppositions).
• Experience with patents and patent laws in Europe and/or other international patent jurisdictions.
• Experience in patent analytics, AI tools, docket management tools, and/or database searching.

Responsibilities

• Member of Legal and Compliance Team; reports to Chief Intellectual Property Counsel.
• Part of the IP Senior Leadership Team; collaborates closely with Chief Intellectual Property Counsel and other senior IP leaders.
• Leads team of IP attorneys and agents that support Endo and Uro divisions.
• IP business partner for Endo and Uro; collaborates with Presidents, VPs of R D, and other senior leaders.
• Develops and implements IP strategy for the Endo and Uro businesses, including IP portfolio management, freedom to operate, licensing, and enforcement.
• Provides legal advice and counsel to company personnel in diverse IP matters by assisting, advising, investigating, researching, and resolving IP legal matters within corporate legal policies to ensure that company personnel are aware of and in compliance with applicable state, federal, and foreign laws and regulations.
• Develops and delivers training to company personnel.
• Reviews, advises, and approves contracts in a variety of areas, including research, supply/manufacturer, distribution, consulting, non-disclosure, clinical investigator, asset purchase, business acquisitions and mergers, and other areas as needed to ensure intellectual property interests are protected.
• Provides legal counsel and support in business development activities, including conducting due diligence, facilitating transfer of legal responsibilities, assisting, and advising on other acquisition-related issues as they arise, and directing outside counsel in assisting the company with IP acquisition issues as needed.
• Participates in national and international litigation matters, patent office proceedings, investigations, and trials by interacting with internal and external legal counsel regarding on-going and actual and/or potential litigation.
• Develops, implements, and revises policies and Standard Operating Procedures consistent with international and US IP laws and regulations and acceptable Company practices.
• Monitors and ensures compliance with Company policies and SOPs.
• Establishes and supports a work environment of continuous improvement that supports BSC's Quality Policy, Quality System, and the appropriate regulations for the area they support.
• Ensure employees are trained to do their work and their training is documented.
