About The Position

The Senior Privacy Counsel at Personify Health is a pivotal role that combines legal expertise in privacy and data security with a focus on healthcare and technology. This position involves managing privacy programs, providing legal counsel on a variety of digital health matters, and supporting the Sales and Customer Success teams. The role requires collaboration with various teams to ensure compliance with privacy regulations and to implement privacy by design in product development.

Requirements

  • JD degree from an accredited law school and a current member in good standing of a US state bar.
  • At least 3 years of experience managing direct reports in a privacy legal role.
  • Deep knowledge of federal and state privacy and data security laws, including HIPAA and CCPA.
  • Experience in in-house privacy legal roles at multinational companies or in the privacy practice of an international law firm.
  • Expertise in drafting and reviewing privacy-related documents and contracts, including data processing agreements.
  • Professional experience in supporting consumer-facing SaaS or e-commerce businesses.

Nice To Haves

  • IAPP certifications such as CIPP/US, CIPP/E, CIPP/A, or CIPP/C.
  • Cybersecurity or AI certifications.

Responsibilities

  • Provide expert legal advice and guidance on digital health matters, including data privacy and security, telemedicine, and mobile health applications.
  • Serve as the lead subject matter expert on domestic and international privacy and data security within the Legal team.
  • Manage a team of 2-3 privacy and compliance team members to address the privacy legal needs of the company.
  • Partner with Legal, CISO, and Product Development teams to instill privacy compliant strategies throughout product development.
  • Conduct privacy and data impact assessments and guide compliant development practices.
  • Review vendor onboarding from a privacy perspective and support the negotiation of supplier and partner privacy agreements.
  • Maintain records of processing activities and map data flow for suppliers and third parties.
  • Assist with cookie policies and practices to ensure compliance.
  • Draft and update privacy policies and template agreements to comply with evolving regulations.
  • Develop and conduct privacy training to fulfill business and compliance needs.
  • Support internal and external audits of global privacy practices.
  • Assist with incident response matters and regulatory inquiries regarding privacy and data security.
