The incumbent will spend approximately 50% of his or her time providing legal counsel to and representing the Bureau of Child Care Food Programs in the administration of the Child Care Food Program, the Afterschool Meals Program, and Homeless Children Nutrition program at the Florida Department of Health. The incumbent will spend approximately 50% of his of her time providing legal counsel and representing the Bureau of WIC in the administration of the Special Supplemental Nutrition Program for Women, Infants, and Children. The incumbent in this position will be required to complete a certification twice a year certifying time worked on the Child Care Food Program. The incumbent will provide legal guidance on the application of relevant federal and state laws, including policies from the United States Department of Agriculture and the Code of Federal Regulations. The incumbent will be responsible for monitoring and communicating legal updates to the Bureaus and Chief Legal Counsel, ensuring they are aware of new rules, policies, and statutes. The incumbent will be responsible for the legal review of all public records requests received by either Bureau. As legal counsel, the incumbent's primary role is to provide expert legal guidance and support to agency programs. The incumbent will maintain legal knowledge and updates of all relevant statutes and rules applicable to the programs and advise the programs of any legal developments. Duties involve interpreting and applying federal and state laws, administrative rules, and case law to a variety of agency activities, including those involving vendors and participants in federal programs. This includes advising on key legal processes like sanctions, financial claims disallowances, and administrative review requests. Additional duties consist of drafting, reviewing, and negotiating a wide range of legal documents, such as contracts, interagency agreements, and memorandums of understanding. The incumbent will provide legal oversight for bureau rulemaking, ensuring full compliance with the Administrative Procedures Act. The incumbent is responsible for reviewing and analyzing all policies and procedures to guarantee they are legally sound, conducting legislative analyses, providing legal opinions, and consulting with staff on legal issues to ensure the agency's actions are legally compliant and effective. Duties will include representing the bureaus in litigation in all forums. The incumbent will be responsible for conducting thorough legal research, per-forming detailed case analysis and developing strategic recommendations for case proceedings. The incumbent will represent the programs in court and ensure that both the programs and Chief Legal Counsel are kept fully informed of all litigation developments. The incumbent performs other duties and responsibilities as assigned or required by the Office of the General Counsel. Participates in and attends educational conferences and other opportunities to enhance personal and professional growth and development. Operates within the Litigation Practice Group and performs assignments as required from the Chief Legal Counsel, Deputy General Counsel or General Counsel.
