About The Position

The New York State Education Department's Office of Professions is seeking a Senior Attorney to provide legal support and representation in professional misconduct cases. This role involves managing investigations, offering legal advice, engaging in settlement negotiations, and representing the office in hearings and before the Regents Review Committee. The position requires a strong legal background and the ability to interact effectively with various stakeholders in the legal and educational sectors.

Requirements

  • Law School graduation AND/OR eligibility for NYS Bar Admission for Assistant Attorney 1.
  • NYS Bar Admission for Assistant Attorney 2.
  • NYS Bar Admission AND 1 year of subsequent satisfactory Legal experience for Assistant Attorney 3.
  • Juris Doctorate degree AND NYS Bar Admission AND at least 2 years of subsequent satisfactory Legal experience for Senior Attorney.

Responsibilities

  • Participate in the development and review of investigations into allegations of professional misconduct.
  • Provide legal advice to OPD investigators and members of the various state boards for the professions.
  • Engage in settlement negotiations in professional misconduct cases.
  • Prepare for hearings on, and try before panels of the various state boards, professional misconduct cases, moral character cases involving individuals seeking licensure, and restoration of license cases involving individuals whose licenses have been previously revoked or surrendered.
  • Represent OPD before the Regents Review Committee on review of decisions of hearing panels in professional misconduct cases.
  • Research and prepare briefs, memoranda of law, specifications of professional misconduct, other legal pleadings, internal memoranda, and correspondence.
  • Effective and timely management of assigned caseload.
  • Interact professionally and effectively with members of the Board of Regents and the various state professional boards, other SED staff, opposing counsel, witnesses, and members of the public.
