About The Position

The Public Defender serves as a defense attorney for indigent clients in criminal and civil cases, ensuring that their constitutional rights are protected and that they receive competent legal representation. This role involves working collaboratively with underprivileged populations to advocate for their needs and improve the level of services provided by the Office of the Public Defender (OPD).

Requirements

  • Juris Doctorate Degree from an accredited law school.
  • Membership in the State Bar of Montana.
  • Knowledge of legal and court policies, procedures, and practices, particularly in indigent defense.
  • Familiarity with state and federal laws, rules, and regulations, and their judicial interpretation.
  • Knowledge of criminal law and criminal procedure in Montana.
  • Ability to work effectively with marginalized populations and understand cultural differences.

Nice To Haves

  • Previous experience in criminal defense preferred.

Responsibilities

  • Represents clients in court and during hearings before legal entities, including cases at the Montana Supreme Court.
  • Provides legal defense in high-profile cases involving significant liability or severe penalties.
  • Reviews and prepares legal documents such as opinions, forms, and contracts.
  • Prepares findings of fact, conclusions of law, and orders after legal proceedings.
  • Prepares evidence, exhibits, and legal documents necessary for litigation.
  • Interprets and applies state and federal laws and administrative rules.
  • Identifies and interviews parties, witnesses, and experts involved in legal proceedings.
  • Receives, researches, and responds to questions or complaints, providing information and facilitating resolutions.
  • Provides legal consultation, recommendations, and advice during settlement negotiations.
  • Collaborates with other attorneys during trials and hearings.
  • Handles cases with substantial legal precedent and analyzes new laws without precedent.
  • Serves as a legal advisor across multiple fields of law and may develop expertise in specific areas.
