Kalshi is seeking a Litigation Counsel to manage the company's dispute and enforcement exposure end-to-end. This role involves managing active and threatened litigation, coordinating with outside counsel, and collaborating with Regulatory and Commercial Counsel teams to proactively address legal risks. The position is ideal for a litigator who thrives in novel legal terrain, as prediction markets are still being defined and the work will shape the legal landscape for a new asset class.

Requirements

  • J.D. from an accredited law school and active bar membership in at least one U.S. jurisdiction
  • 4–8 years of litigation experience, with a meaningful track record of managing complex commercial, regulatory, or financial services disputes
  • Demonstrated ability to independently manage litigation matters from pre-suit through trial or settlement, including discovery, motion practice, and case strategy
  • Experience with or strong interest in CFTC, SEC, or other financial regulatory enforcement proceedings
  • Strong legal writing and oral advocacy skills, with the ability to distill complex disputes into clear strategic options for business stakeholders
  • Sound judgment under pressure, with a practical orientation toward resolving disputes efficiently and protecting the company's long-term interests
  • Collaborative instincts and comfort working cross-functionally - you'll be deeply embedded with Regulatory, Compliance, and Commercial teams, not siloed in a litigation silo

Responsibilities

  • Own Kalshi's litigation docket, including all active and threatened disputes, regulatory enforcement matters, and pre-litigation demands - managing strategy, deadlines, and outside counsel from inception through resolution
  • Serve as primary liaison to outside litigation counsel, setting strategy, controlling legal spend, and ensuring that Kalshi's business interests are front and center throughout every matter
  • Advise senior leadership on litigation risk, anticipated exposure, and strategic options across commercial disputes, CFTC enforcement proceedings, market participant complaints, and novel event-contract disputes
  • Partner with the Regulatory Counsel team on government and agency investigations, subpoenas, civil investigative demands, and enforcement inquiries from the CFTC and other regulators
  • Conduct and manage internal investigations, working cross-functionally with Compliance and Surveillance teams to gather facts, assess exposure, and recommend remediation
  • Draft and review litigation-related documents including demand letters, tolling agreements, litigation holds, and settlement agreements
  • Support arbitration proceedings and alternative dispute resolution processes involving market participants, counterparties, and commercial partners
  • Monitor litigation trends, enforcement actions, and case law developments in the derivatives, prediction markets, and broader fintech space, and proactively advise the business on implications
  • Build and maintain internal playbooks and protocols for dispute escalation, litigation holds, and outside counsel engagement
