About The Position

The Office of the New York State Attorney General's Investor Protection Bureau is seeking an Assistant Attorney General to support the Franchise Section. This role involves enforcing the New York State Franchise Sales Act, ensuring compliance with registration requirements, leading investigations into violations, supporting litigation, and assisting in supervising the section. The position aims to protect the public from fraud and misrepresentation in the investment sector, particularly concerning franchises.

Requirements

• A minimum of five (5) years of relevant post-graduate legal experience.
• Excellent analytical, writing, research, teamwork, and organizational skills.
• Admission to practice law in New York state and residency in New York state or intent to become a resident.

Nice To Haves

• Experience with franchise law, fraud, financial markets, or accounting.
• Prior work experience as a regulatory attorney.

Responsibilities

• Perform compliance reviews of Franchise Disclosure Documents (FDDs) to ensure regulatory compliance and issue comment letters to address deficiencies.
• Conduct investigations, including issuing subpoenas, analyzing documents, taking testimony, drafting pleadings, litigating, and drafting settlement documents against non-compliant franchisors.
• Ensure compliance with the Franchise Sales Act through sweeps, undercover investigations, and coordination of the annual Franchise Sales Expo.
• Review and investigate complaints against franchisors from the public and other regulators.
• Stay updated on trends in franchise law, build relationships with other agencies, and propose amendments to franchise laws and regulations.
