About the position

This position requires the investigator to evaluate each case for compliance with all Labor Department jurisdictional programs. This position will investigate both claims and complaints filed by employees against current or former employers. This position conducts site visits related to youth labor injuries and complaints, takes photographs, determines exemptions, and educates employers on variation provisions. This position will report directly to the Labor Division Manager. This position may offer the ability to work remotely, within Arizona, based upon the department's business needs and continual meeting of expected performance measures.

Responsibilities

  • Conducting investigations regarding Labor Department jurisdictional programs including Wage, Minimum Wage, Earned Paid Sick Time, Youth Labor, Payment Compliance and Retaliation complaints.
  • Investigating employers for compliance issues; if the employer is found to be out of compliance the Investigator will provide education and recommend whether or not a civil penalty is warranted.
  • Review investigative cases: contact involved parties via telephone, email, in person or by regular mail.
  • Obtain documentation and weigh evidence received to determine pertinent issues.
  • Interview involved parties, conduct mediation conferences to negotiate settlements between opposing parties.
  • Educate employers and employees on all Labor Department jurisdictional programs.
  • Compose detailed, comprehensive activity logs of investigative actions taken, information received; and relevancy of facts uncovered.
  • Keep detailed written notes of conversations with involved parties.
  • Render a decision on investigations conducted and write complete, concise determinations in narrative format using findings of fact, and a final order.
  • Process public records requests and appeals.
  • Maintain the 'laboradmin' email. Answer public inquiries by phone, e-mail, in-person and written correspondence concerning Arizona Labor statutes, administrative rules and policies and procedures.

Requirements

  • Knowledge in Arizona administrative practices and procedures is preferred.
  • Knowledge in Arizona state wage payment, minimum wage, EPST, retaliation and youth labor statutes and provisions of federal Fair Labor Standards Act.
  • Knowledge of the ICA and Labor Department's purpose, goals, policies, procedures and practices, is preferred.
  • Knowledge of information and evidence relevant to specialized and complex labor related enforcement issues.
  • Knowledge of Microsoft office, web and database.
  • Skills in effective written and oral communication.
  • Skills in operating a personal computer.
  • Skills in assessing work situations and rendering appropriate problem solving techniques.
  • Skills in developing and implementing training.
  • Skills in interpreting and applying laws, rules and agency procedures.
  • Ability to understand and work within scope of authority.
  • Ability to work independently, without direction.
  • Ability to establish and maintain cooperative and effective working relationships with others.
  • Ability to meet established timelines.
  • Ability to recognize and engage those with different backgrounds, characteristics, and perspectives.
