About The Position

With minimal supervision, plans, reviews cases, and recommends appropriate litigation strategies for property and casualty claims against the City of Charlotte, Mecklenburg County, the Charlotte Mecklenburg Board of Education, and Medic. This position is responsible for events and claims identified as pre-litigation or are reserved in an amount greater than $100,000.This position provides an interface between claims personnel, insurance companies, claims administrators, in-house attorneys, and outside litigation counsel. The position is responsible for maintaining the status of claims and advising on proper strategies for claims management, some of which can have multi-million dollar outcomes and result in significant case law.

Requirements

  • Holds a North Carolina Adjuster's license for property and casualty claims.
  • Holds an Associate Degree in Senior Claims Law, or has the ability to obtain.
  • Associate in Risk Management for Public Entities (ARM-P) designation, and/or Associate in Insurance Claims (AIC) designation.
  • State of North Carolina driver's license.
  • Through knowledge of laws applicable to liability claims.
  • Thorough knowledge of investigative and adjustment techniques, procedures, and practices involving Liability claims.
  • Knowledge of local government, organization, functions, and safety provisions.
  • A current working knowledge of governmental immunity statutes.
  • Ability to analyze facts and exercise sound judgment in negotiation, adjustment, and investigation matters.
  • Ability to communicate clearly and concisely both orally and in writing.
  • Ability to conduct public speaking and presentations, as needed.
  • Ability to supervise and train subordinates in a manner conducive to full performance and high morale.
  • Ability to keep and maintain records and to prepare and submit accurate reports.
  • Ability to establish and maintain effective working relationships.
  • High School Graduate or Equivalent and nine (9) years of related work experience OR 2 Year College Degree and seven (7) years of related work experience OR Bachelor's Level Degree and five (5) year of related work experience OR Master's Level Degree and three (3) year of related work experience or an equivalent combination of education and relevant experience that provides the necessary knowledge, skills, and abilities to successfully perform the essential job duties.

Responsibilities

  • Plans, assigns, and coordinates claims defense and mitigation activities for claims identified as pre-litigation and litigation.
  • Consults with internal and external attorneys.
  • Provides support to defense attorneys by attending depositions as necessary.
  • Attends and participates in mediations.
  • Assists defense attorneys in the identification and engagement of expert witnesses.
  • Manages complex claims of a sensitive nature, large loss, or serious injury, including fatalities.
  • Provides review and analysis for difficult cases and recommends appropriate action to team members.
  • Supervise and oversee staff performance.
  • Work with the Third-Party Administrator to ensure contract adherence.
  • Makes recommendations regarding administrative policies and procedures.
  • Prepares complex oral, written, and statistical reports.
  • Fulfill Public Records Requests on behalf of Risk Management.
  • Audits the accuracy/adequacy of financial reserving.
  • Audits files and assures conformity to state and federal rules and regulations.
  • Attends meetings, conferences, and seminars concerned with designated areas of responsibility.
  • As required by customers, attends closed session strategy/settlement meetings with elected officials.
  • Report and provide status reports to excess insurance carriers and to financial auditors.
  • Maintain the confidentiality of information and professional boundaries.
  • Performs related duties as required.
