About The Position

The Inmate Disciplinary Hearing Officer is a licensed attorney who presides over administrative proceedings involving incarcerated individuals at assigned correctional facilities. This position requires the officer to arrange for witness testimony and documentary and video evidence, ensuring that appropriate standards of due process are met. The officer must determine the relevancy and admissibility of evidence while demonstrating appropriate demeanor and impartiality throughout the hearing process. Additionally, the officer evaluates evidence presented, resolves issues of law and fact, and considers mitigating and aggravating circumstances. The officer is responsible for preparing decisions that include statements of the evidence relied upon and thorough explanations for the dispositions rendered, including the justification for any sanctions or programmatic referrals imposed. The hearings conducted are electronically recorded, and a complete paper record is developed for potential future litigation. The officer maintains an appropriate degree of independence and regular contact with Counsel's Office supervisory staff. Additional duties may include attendance at departmental trainings, meetings, occasional travel to assist other hearing officers, and drafting of Freedom of Information Law (FOIL) appeal responses on behalf of the Department.
