About The Position

Health Care related Attorney who will provide research and legal advice to health care professionals of the Choctaw Nation of Oklahoma. You will report to the Director. Mon-Fri 8:00 AM to 4:30 PM Primary Tasks: You will research the intent of laws and judicial decisions and applies the law to the circumstances. Work on unusual or complex problems and provide solutions. You will negotiate contractual agreements and provide legal advice to avoid legal liability. Provide legal representation to the Nation in all requested and required legal and liability areas. You will manage the case management of in-house matters. You will be advising operational leaders, clinicians, and executives on legal and regulatory risk. You will be drafting, reviewing, and negotiating healthcare-related agreements, including physician employment and professional services agreements; vendor, technology, and managed services contracts; affiliation, joint venture, and value-based care arrangements. You will be supporting compliance programs, internal investigations, regulatory investigations and audits, and fraud and abuse investigations. Prepare, negotiate, review and advise on work pertaining to contracts, agreements, and other legal instruments on behalf of the Nation. Provide guidance to lower-level Attorneys. Perform other tasks as may be assigned.

Requirements

  • Juris Doctorate from an accredited law school
  • Licensed to practice law by a State within the United States
  • Ability to handle a variety of legal fields and procedures
  • Minimum Six [6] years’ experience as an attorney in the health care field
  • Experience advising operational leaders, clinicians, and executives on legal and regulatory risk
  • Experience in drafting, reviewing, and negotiating healthcare-related agreements, including physician employment and professional services agreements; vendor, technology, and managed services contracts; affiliation, joint venture, and value-based care arrangements
  • Experience supporting compliance programs, internal investigations, regulatory investigations and audits, and fraud and abuse investigations
  • Strong working knowledge of healthcare legal and regulatory frameworks, including HIPAA/HITECH and patient privacy laws; Stark Law, Anti-Kickback Statute, and False Claims Act; Medicare/Medicaid certifications, reimbursement, and compliance requirements

Nice To Haves

  • Grasp of the legal issues and requirements of the tribe’s commercial ventures, such as licensing, acquisition and divestiture
  • Advance understanding of tribal law, sovereignty, and tribal court proceedings

Responsibilities

  • Prepare, negotiate, review and advise on work pertaining to contracts, agreements, and other legal instruments on behalf of the Nation.
  • Provide guidance to lower level Attorneys.
  • Perform other tasks as may be assigned.
