About The Position

The General Counsel for the Department of Elder Affairs serves as the principal legal advisor, representing the Department in litigation and administrative proceedings. This role involves providing legal counsel to the Secretary and staff, supervising general counsel staff, and ensuring compliance with legal standards related to the Department's programs, particularly in relation to Medicaid. The position is integral to promoting the well-being and rights of Florida's seniors and requires a strong commitment to the agency's mission and vision.

Requirements

  • Must be a member of the Florida Bar and in good standing.
  • Extensive knowledge of Florida Statutes and legal procedures.
  • Ability to interpret state and federal legislation, laws, and rules.
  • Skill in reading comprehension, analysis, research, and organization.
  • Ability to provide legal counsel and foresee possible legal problems.
  • Ability to communicate effectively and concisely, both verbally and in writing.

Responsibilities

  • Represent the Department in all litigation and administrative proceedings.
  • Advise the Secretary of Elder Affairs and staff on legal matters.
  • Supervise general counsel staff, including training and evaluating work.
  • Plan, organize, budget, and direct legal services for the Department.
  • Serve as the state legal assistance developer as required by the Older Americans Act.
  • Ensure compliance with Medicaid-related inter-agency agreements and provide legal counsel regarding Medicaid laws.
  • Conduct legal research and prepare legal opinions on inquiries from within and outside the Department.
  • Prepare and review legal instruments such as contracts and agreements.
  • Oversee rule-making proceedings and ensure compliance with legal requirements.
  • Perform other duties as assigned by the Secretary.
