About The Position

The North Carolina Department of Labor is charged by statute with promoting the health, safety and general well-being of the workers in the state. The laws and programs the Department administers affect every worker in the state. The Department is organized into three primary divisions which carry out the Department's principle regulatory, enforcement and promotional programs, and the administrative operations. The three primary divisions have divisions, bureaus and offices under each, which carry out the specific and specialized portions of the NCDOL mission. The primary purposes of the EDB Discrimination Investigator are to 1) conduct timely, thorough, and impartial investigations of all complaint files assigned to him/her; 2) prepare a Report of Investigation in each file and issue a determination as to whether or not there is reasonable cause to believe that the allegations in the complaint are true and that they constitute a violation of REDA; 3) at all times conduct him/herself in a professional, neutral, and ethical manner, and in accordance with NCDOL and EDB policies, procedures and expectations; 4) respond to inquiries from workers, attorneys, employers, unions, the public, trade associations, other North Carolina Department of Labor employees, and other state and federal agencies as necessary; and 5) work cooperatively with the staff of the Bureau to provide excellent customer service to complainants, respondents, and the public at large. The Discrimination Investigator is the case manager of each complaint file assigned to him/her. As such, the investigator develops a process and a strategy for undertaking the investigation, maintains accurate records of all activities in the case, and determines and communicates the outcome to the parties. The investigator is expected to handle a large caseload.

Requirements

  • Demonstrated ability to communicate clearly and effectively both orally and in writing.
  • Demonstrated experience applying investigative principles and techniques.
  • Demonstrated experience with reviewing an extensive amount of information and documentary evidence to determine the facts relevant to the issues in the case and accurately apply the law to the facts.
  • Demonstrated ability to analyze information and make correct inferences or draw accurate conclusions and convey them effectively in a comprehensive report.
  • Competence with a Windows-based computer system and proficiency with WORD, Excel, and online database management and storage systems
  • Bachelor’s degree preferably in occupational safety or health, industrial engineering, industrial relations or labor relations, law or related area from an appropriately accredited institution and three years of experience in discrimination investigations, legal or regulatory investigations, including occupational safety and health investigations, regulatory investigations, workers’ compensation programs or other relevant investigatory experience; or an equivalent combination of education and experience.

Nice To Haves

  • Candidates that are fluent in speaking, reading and writing in English and Spanish.
  • Working knowledge of the Retaliatory Employment Discrimination Act and the North Carolina common law employment at will doctrine is preferred.
  • Basic knowledge of N.C. Public Records Act; federal and N.C. Wage and Hour Acts; federal and N.C. Occupational Safety and Health Acts; National Labor Relations Act; Title VII of the 1964 Civil Rights Act; Age Discrimination in Employment Act; Americans with Disabilities Act; and the federal Family & Medical Leave Act is preferred.
