About The Position

The Office of Special Education Services (OSES) plays a critical role in ensuring that the South Carolina Department of Education (SCDE) provides parents, schools, and other interested parties with access to the full range of special education dispute resolution options required under the Individuals with Disabilities Education Act (IDEA). Under the direction of the OSES Director and the Review and Analysis Team Lead, the OSES State Complaint Investigator is responsible for investigating special education complaints in accordance with 34 CFR §§300.151-153, preparing and issuing formal complaint investigation reports, and assisting in the development, review, and revision of policies and procedures to ensure that special education dispute resolution processes for public schools, parents, and the SCDE align with all applicable federal and state laws and regulations. This position is located in the Office of Special Education Services.

Requirements

  • A bachelor's degree and experience in education, management or business.

Nice To Haves

  • A master's degree or juris doctor and two (2) years of relevant experience, or a bachelor's degree and five (5) years of relevant experience.
  • Experience in education, law, regulatory compliance, or public sector project management.
  • Advanced computer proficiency; relevant office software proficiency; and educational technology proficiency.
  • Knowledge of the Individuals with Disabilities Education Act (IDEA) and experience with the implementation of the IDEA at the local educational agency (LEA) and/or state educational agency (SEA) level.
  • Ability to manage multiple priorities and meet deadlines, supported by a high level of organization and time management skills.
  • Ability to communicate effectively, both verbally and in writing, with a persuasive and professional approach tailored to various audiences.

Responsibilities

  • Investigate formal written complaints pertaining to specific students and issues letters of resolution to address findings of noncompliance under the Individuals with Disabilities Education Act (IDEA), applicable federal regulations, and State Board of Education (SBE) regulations. Ensure written decisions are provided to both the Local Educational Agency (LEA) and the complainant within sixty calendar days of the SCDE's and LEA's receipt of the complaint.
  • Collaborate with other staff members on the collection, analysis, and presentation of data related to the Annual Performance Report (APR) for Part B of IDEA, federal accountability reports, and other data requests involving dispute resolution.
  • Collaborate with other staff to present relevant information to stakeholders on issues related to the complaint process, dispute resolution procedures (including related data), and compliance with IDEA and applicable federal and state regulations affecting students with disabilities.
