The Director of Privacy and Compliance is primarily responsible for developing, implementing, and administering policies, programs, and procedures related to compliance, privacy and data protection legal and regulatory requirements in the Subrogation business. This role will have a high level of interaction with the Subrogation business team, external customers, and strategic partners to provide timely updates and counsel on privacy, compliance, legal and regulatory issues. Additionally, this role may manage incident and breach investigations, develop compliance communications, educate team members on privacy and compliance topics, ensure information minimization and appropriate use, and oversee individual rights requests and programs.

Requirements

  • 4+ years working on privacy and compliance matters in the healthcare industry, either at a law firm or in-house with a corporate law department
  • 2+ years of experience in healthcare industry with familiarity in laws and regulations that are implicated by healthcare commercial contracts
  • Experience supporting HIPAA Privacy and Security Rule and U.S. state privacy laws
  • State bar membership
  • Proficiency with necessary software and IT tools, including Word, Excel, and Outlook

Responsibilities

  • Serve as a subject matter expert in areas of data use and protection laws (including U.S. state and federal consumer protection and privacy laws) and provide practical advice that achieves business objectives
  • Demonstrate subject matter expertise by providing guidance using relevant data protection laws and regulations to support enterprise research in the U.S.
  • Support colleagues across the legal department and business team in structuring, drafting, and negotiating transactional documents
  • Provide legal support and advice with respect to health information security matters, including cybersecurity incidents
  • Work closely with sales and operational teams to evaluate the impact of privacy laws, regulatory guidance, and enforcement actions
  • Drive high-profile and high-impact projects involving privacy analysis and compliance with cross-functional stakeholders across the business
  • Help to develop and conduct general and role-specific privacy training
  • Advise and counsel sales and marketing, business development, research and development, and other executives, managers, and directors of the company with respect to corporate transactional matters from a data protection standpoint
  • Advise and counsel on general corporate matters beyond privacy and data protection areas of law, as directed
  • Support business professional-development needs and interests
  • Manage related work of outside counsel in support of the company's activities
  • Conduct research, monitor and communicate changes to federal, state, and local laws, regulations, and requirements to promote and ensure compliance
  • Support the collection of data for regulatory filings, coordinate and develop reports, projects, and assessment tools to verify compliance and mitigate risks
  • Respond to reported compliance issues, develop, and facilitate corrective action as necessary
  • Provide input on development and deployment of compliance education programs, reporting on and monitoring adherence to employee training requirements
