About The Position

DPS is currently accepting applications for the position of Deputy General Counsel (Assistant Agency General Counsel II) with the Office of the General Counsel in Raleigh, NC. The Deputy General Counsel (Assistant Agency General Counsel II) develops advanced legal positions in complex legal matters of significant interest to the agency and to the State of North Carolina. This position provides daily oral and written legal advice and counsel to the General Counsel, Chief Deputy General Counsel, Director of Purchasing and Logistics, Director of Communications, Executive Directors of several boards and commissions in the department, Chief of Staff, division heads, and other employees on a myriad of topics related to their statutory duties and responsibilities. This position also serves as a liaison to the Attorney General’s Office and provides guidance as necessary or requested regarding statutes, policies, and rules applicable to pending litigation. This position decides the best legal strategy to use to best achieve the agency’s goals.

Requirements

  • Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.

Responsibilities

  • Directing and supervising two (2) attorneys on a daily basis.
  • Analyzing the strengths and weaknesses of cases to develop effective litigation strategy and arguments to achieve the agency’s desired result.
  • Drafting advisory letters and formal opinions on new or complex legal issues; drafting statutes, policies, rules, and amendments which have a broad impact on programs or create new agency programs.
  • Monitoring pending litigation involving DPS and provides technical assistance to the Attorney General’s Office in matters related to procurement and public records laws, in anticipation of litigation or after litigation is filed.
  • Providing legal advice to executive and senior management in the areas of procurement and public records laws.
  • Reviewing public records requests, subpoenas (including subpoenas for personnel records, juvenile records, and law enforcement investigative records), and petitions for release of custodial law enforcement agency recordings.
  • Drafting and reviewing agency memorandums of agreement and contracts.
  • Responding to requests from the agency’s boards and commissions on Open Meetings laws.
  • Conducting or directing legal research and analysis of the broad spectrum of legal issues affecting agency action and providing legal advice based on the results of that research and the employee’s knowledge and experience.
  • Examining and evaluating federal and state legislation, case law, administrative rules, and regulatory requirements, as well as consideration of secondary sources including relevant research, articles, and treatises.
  • Representing executive management at mediations and court-hosted settlement conferences (with settlement authority) upon request.
  • Completing special assignments (usually confidential, highly sensitive and urgent in nature) which have been assigned by the Secretary, Chief of Staff, General Counsel or Chief Deputy General Counsel.
  • Delivering training to DPS staff on an as-needed basis.
