Position Summary McCarthy Building Companies, Inc., is currently searching for a Corporate Counsel to support its Southern Region. This position will be located in our Dallas, Texas office and will report to the Vice President Legal. The Corporate Counsel position entails being a team member in a forward-thinking, dynamic Legal Department that is highly integrated within the organization. Our lawyers are valued and respected for their legal advice, but also for their input on the business side of the deal.

Requirements

  • Juris Doctorate from an ABA accredited law school
  • Licensed to practice law in at least one state in the United States, preferably Texas
  • Minimum of 5 years of experience as an attorney
  • Ability to communicate with other members of the legal department articulately, concisely, and with well-reasoned opinions
  • Ability to communicate complex legal concepts to non-attorney McCarthy team members in a concise, yet thorough, manner
  • Excellent verbal and written communication skills
  • Strong interpersonal, teamwork and diplomatic skills
  • Proven ability to handle multiple projects, prioritize, and meet deadlines
  • Meticulous attention to detail and quality of work product
  • Ability to work independently and determine creative solutions
  • Versatility, flexibility, and willingness to work within constantly changing priorities with enthusiasm

Nice To Haves

  • Experience with construction law as well as familiarity with design and construction agreements is a plus

Responsibilities

  • Provide legal advice in all aspects of construction law, as well as ancillary legal areas applicable to a national multi-billion-dollar corporation in the construction industry, such as disputes related to contract, delay, payment, construction defect, and injuries, litigation, and insurance matters, among others.
  • Provide advice on procurement matters related to public and private works construction projects in a variety of industries, procurement types and delivery methods, including federal and federally funded construction projects.
  • Assist operations in disputes involving owners, architects, subcontractors and consultants.
  • Conduct moderate to complex legal research on a variety of topics in multiple states that relate to the business.
  • Manage subcontractor defaults; work with operations to ensure that McCarthy's interests are properly protected by subcontractors' bonding companies; assist in managing litigation arising out of any breach of payment or performance bonds.
  • Provide advice on the Company's labor strategy in connection with existing labor agreements, project labor agreements as well other project labor requirements, including prevailing wage and apprenticeship ratios.
  • Assist in communications with national, state and local regulatory agencies, such as Occupational Health and Safety Administration, Storm Water Regulatory Agencies, and the National Labor Relations Board.
  • Draft memoranda, correspondence, and reports summarizing research findings and offer opinions regarding liability, risk transfer and exposure.
  • Assist in identifying and managing complex builder's risk insurance, professional liability insurance and general liability insurance issues on a variety of different project types in both pre-litigation and litigation situations.
  • Assist project teams in understanding and pursuing insurance coverage for construction defect, builder's risk, pollution, professional, auto, worker's compensation and property damage claims while working in conjunction with the Risk Management Department.
  • Assist with all aspects of litigation - respond to document requests, prepare discovery responses, review and edit motions, briefs and memoranda from outside counsel; manage outside counsel throughout the pre-litigation and litigation processes.
  • Assist in preparation for and attend alternative dispute resolutions.
  • Provide general legal advice to McCarthy team members.
