Your Role at Baxter This role will provide key support to Baxter's various business divisions and Baxter’s contracting and digital/website business teams addressing overall data privacy compliance, as well as support the day-to-day management of Baxter’s privacy program in the US in accordance with Baxter’s Global Privacy Policy and applicable privacy laws (e.g., HIPAA, CCPA/CPRA and other state laws). The role will partner with senior functional leaders in order to: (i) mobilize resources across the organization to implement the data privacy program, so that Baxter employees can achieve their business goals consistent with Baxter’s values and standards and applicable data protection legal requirements, and (ii) enable the development and execution of innovative data-driven business initiatives while ensuring compliance with data privacy and data protection laws. This position will report to the Associate General Counsel, Legal - Privacy, Security and Digital - US.

Requirements

  • Law Degree from a US jurisdiction and bar membership.
  • 7+ years of professional experience in an international company or in an international law firm in the area of data protection.
  • The ideal candidate will have experience gained from a mix of law firm private practice and in-house positions in companies engaged in the life-sciences sector.
  • Healthcare experience required.
  • Expert knowledge of US federal and state data privacy laws (such as HIPAA, CCPA/CPRA).
  • Experience in managing data incidents and breaches.
  • Proven experience counseling business clients on an international level.
  • Ability to work independently and navigate ambiguous legal issues.
  • Demonstrated ability to work with others in addressing privacy issues in a pragmatic way and within complex organization environment.
  • High degree of accountability, professional motivation, and drive with the resulting ability to thrive in a results-oriented culture while driving excellence to optimize the execution of transactions.
  • Strong collaborative skills to support teammates and work towards common goals to achieve shared success.
  • Proven history of proactively identifying and researching legal risks and issues and effectively counseling clients regarding same providing actionable risk mitigation strategies.
  • Strong ability to work with and coordinate activities across a large number of individuals across various functional areas and effectively communicate the impact of law and regulation on business operations in a solutions-oriented manner.
  • Fluency in English.

Responsibilities

  • Act as an advisor and subject matter expert for Baxter's business divisions and support the initiatives, projects, and products assessments providing practical, timely, strategic, and high-quality legal advice on data privacy and implementation under applicable privacy laws.
  • Support Baxter contracting/procurement teams and commercial teams regarding data privacy legal questions, contract reviews, and negotiations, including, but not limited to, drafting and negotiating Business Associate Agreements and/or Data Processing Agreements, as applicable, with Baxter’s vendors and customers.
  • Advise marketing and digital teams to lead privacy compliance on websites with a focus on privacy notices, cookie banners, opt-out mechanisms, and tracking technologies and controls consistent with applicable privacy laws.
  • Monitor developments in US privacy laws (e.g., HIPAA, CCPA/CPRA, state laws) and related legislation and industry practices and support operationalization of compliance.
  • Develop and perform trainings, as needed, following the Baxter Privacy Office Curriculum and functional needs.
  • Be able to act independently and provide expert legal advice and counsel to Baxter on privacy compliance matters.
  • Partner and interact closely with business and/or functional leaders and/or teams in the identification of privacy related issues and support in the efficient resolution.
  • Identify areas of vulnerability and risk and undertake corrective plans to resolve the issues.
  • Conduct or support internal investigations of allegations of potential data breaches.
  • Lead data subject requests as per privacy laws.
  • Conduct privacy assessments, including Data Protection Impact Assessments (DPIAs), as required in the geographies under the supervision of Baxter Privacy Office.
  • Maintain up to date privacy expertise, skills, and competency regarding evolving laws, regulations, guidance, and directives impacting Baxter.
