About The Position

Arcadis seeks a Commercial Manager to join the Major Projects team in Atlanta to plan and execute Design-Build projects. You will be responsible for overseeing all commercial aspects of our projects from inception through to completion. You will play a crucial role in identifying and managing risks, negotiating project agreements, ensuring profitability, and fostering strong client relationships.

Requirements

  • 8+ years of experience in commercial management, contract negotiation, and financial oversight within the construction or engineering industry, ideally with exposure to design-build projects.
  • Bachelor’s degree in Business Administration, Finance, Engineering, or a related field.
  • Strong understanding of contract law, project finance principles, and commercial terms and conditions.
  • Excellent analytical skills with the ability to identify risks posed by contract documents, including scope and technical provisions, as well as the ability to discern contractual rights and advise project teams on strategies for enforcement.
  • Effective communication and negotiation skills, with the ability to interact professionally with clients, subcontractors, and internal teams.
  • Proficiency in Microsoft Office Suite (Excel, Word, PowerPoint), and familiarity with project management and project controls software.

Nice To Haves

  • JD or relevant advanced degree preferred.
  • Familiarity with commercial considerations for alternative delivery projects, including public-private partnerships, design-build, and progressive design-build, preferred.
  • Experience performing schedule delay analysis preferred but not mandatory

Responsibilities

  • Review and propose revisions to RFPs, Teaming Agreements, NDAs, Joint Venture Agreements, and other types of contract documents.
  • Lead the negotiation, drafting, and administration of contracts with clients, joint venture partners, subcontractors, and suppliers, collaborating with legal counsel as needed.
  • Identify and assess project risks related to commercial aspects, including contractual structure and obligations, payment terms, and insurance requirements. Develop risk mitigation strategies and monitor implementation.
  • Ensure compliance with regulatory and contractual requirements related to commercial activities such as subcontracting and procurement.
  • Establish, deploy, and oversee Change Management and Claims administration, including: Developing and drafting Project Change Management Plans based on contractual requirements, providing project teams with step-by-step directions and deadlines for when potential changes or claims arise;
  • Investigating and gathering documentation necessary to substantiate potential claims, in coordination with Project Controls and technical teams;
  • Drafting formal correspondence related to changes, claims, or any other commercial matters.
  • Serve as a primary point of contact for clients, joint venture partners, and subcontractors regarding commercial matters. Build and maintain strong relationships, understand client needs, and ensure timely resolution of issues to enhance project success.
  • Coordinate with technical teams to assist in the preparation of bids and proposals for Design-Build projects.
  • Manage subcontractor/subconsultant relationships. Monitor subcontractor adherence to contractual obligations and advise project management regarding commercial approach if issues arise, drafting formal correspondence when necessary.
  • Work closely with Project Controls to ensure alignment with commercial strategies and objectives.
