About The Position

The Attorney experiences a wide array of policy and legal topics that impact the Department's day-to-day operations. This includes constitutional law, labor law, contracts, tort law, civil rights, and administrative law. This position collaborates with Department staff and stakeholders providing written and oral legal advice on the Department's policy and programming directives and provides advice on all matters pertaining to public employment, including employee discipline, pre-termination due process, state classification and compensation, employee grievances, FMLA and ADA, and matters concerning collective bargaining units.

Requirements

  • Juris Doctorate from an ABA accredited law school.
  • Admission to the State Bar of Montana or admission within one year from the date of hire.
  • At least two years of experience as a practicing attorney is preferred.
  • Eligible to be admitted to practice in federal district courts; Ninth Circuit U.S. Court of Appeals; and the U.S. Supreme Court, as required.
  • Alternative combinations of education and experience will be considered on a case-by-case basis.

Responsibilities

  • Assisting in the Department's contracting processes, including drafting, reviewing, and negotiating contracts, requests for proposals, memoranda of understanding, and labor union agreements.
  • Developing, drafting, and promulgating Department policies, procedures, and administrative rules.
  • Reviewing and assisting with public records requests.
  • Supporting the Department in the legislative process, including drafting and reviewing legislation and fiscal notes.
  • Providing training and ongoing guidance for both new and existing staff.
  • As needed, support and represent the Department in ongoing legal proceedings, including court proceedings, administrative hearings, investigations, arbitration, and mediation.
