About The Position

The Rule 40 Staff Attorney is assigned to the Criminal Administrative Judge of the First Circuit Court who oversees criminal cases in the First Circuit. The Staff Attorney focuses on Rule 40 of the Hawaii Rules of Penal Procedures and conducts in-depth legal research, analyzing complex legal issues, and drafting comprehensive legal memoranda and proposed rulings to the Criminal Administrative Judge, the multiple criminal divisions of the First Circuit, the criminal assignments branch of the First Circuit, and related criminal division issues within the First Circuit Administration; and perform other duties as required.

Requirements

  • Hawaii Bar License Requirement: Applicants must possess an active license to practice law in all courts of the State of Hawaii. Applicants who have an INACTIVE license may apply, however, verification of current and ACTIVE license is required upon selection.
  • Education Requirement: Graduation from an accredited school of law.
  • General Experience Requirement: Three (3) years of work experience which demonstrated the satisfactory performance of duties in one or more of the following areas (or the equivalent): legal research and writing; litigation; review of and drafting of legislation; review of new laws for impact on court requirements; or development of policies and procedures, and legal forms to implement new laws.
  • Supervisory Aptitude: Applicants must possess Supervisory Aptitude. Supervisory aptitude is the demonstration of aptitude or potential for performing supervisory duties through successful completion of regular or special assignments which involve some supervisory responsibilities by detail to supervisory positions; by completion of training courses in supervision accompanied by application of supervisory skills in work assignments; or by favorable appraisals of a supervisor indicating the possession of supervisory potential.

  • Draft comprehensive legal memoranda and proposed rulings to the Criminal Administrative Judge, the multiple criminal divisions of the First Circuit, the criminal assignments branch of the First Circuit, and related criminal division issues within the First Circuit Administration.
  • Perform other duties as required.
