About The Position

The Office of Data Privacy is responsible for managing a diverse portfolio of legal work and providing legal counsel to the senior executive staff within the New York City Department of Social Services (DSS), the New York City Human Resources Administration (HRA) and the New York City Department of Homeless Services (DHS), including the DSS General Counsel and the DSS Commissioner on complex and high-level legal issues related to data privacy, data security and data privacy risk management. The Office also provides legal support to several mayoral initiatives and Agency reform efforts. The Office of the General Counsel of the Office of Legal Affairs (OLA) is recruiting for one (1) Agency Attorney Interne within the Office of Data Privacy who will work under the supervision of a Senior Attorney and under the general direction of the Chief Data Privacy Officer providing legal services on behalf of the DSS Commissioner on legal matters with significant financial, procedural and policy impact. The Attorney Interne will: - Assist in providing legal counseling and assistance to all agency program areas and departments within the New York City Department of Social Services (DSS)/the New York City Human Resources Administration (HRA)/the New York City Department of Homeless Services by researching legal issues related to data privacy, data security and data privacy risk management. - Assist in preparing complex legal opinions on matters of significant importance to the City of New York. Work closely with the Corporation Counsel, the Citywide Privacy Officer and counsel for the Office of Technology and Innovation (OTI) on citywide initiatives issues related to data privacy, data security, artificial intelligence and data privacy risk management. - Draft and review legal opinions, memoranda of law, executive summaries, non-disclosure agreements (NDAs), data sharing agreements, system access agreements, contractual provisions, authorizations, terms of use, legal correspondence, policies and procedures, research proposals, audit requests, executive orders. - Review and comment on proposed local, state and federal legislation and research proposals. - Responsible for handling all aspects of data security incident response. - Prepare and deliver presentations within and outside the Agency on issues related to data privacy and data security. - Attend high level meetings with senior executive staff and assist in providing legal opinions and legal counsel directly to the General Counsel and other senior executive staff. - Assist with the management of administrative projects to improve Privacy's internal business operations. - Assist with record retention protocols - Assist with AI Risk Management, including drafting use cases, creating an inventory of AI tools, conducting risk assessments, and evaluating the pros and cons of tools prior to procurement.

Requirements

  • Graduation from an accredited United States law school as defined in the Rules of the New York Court of Appeals (Sections 520.3 or 520.5) or admission to the New York State Bar.
