About The Position

The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs’ and Criminal Justice Education and Training Standards Divisions. The primary purpose of this Attorney II position is to defend civil actions brought against employees of DAC. This position shares responsibility with several other attorney positions for providing all legal support services. This is a civil litigation position that offers an unparalleled opportunity to gain extensive litigation experience in federal court, from drafting pleadings, briefing dispositive motions, to jury trials. The attorney in this position, like all positions within the DOJ, will also be part of a rotation of attorneys that handles criminal appeals on behalf of the State.

Requirements

  • Licensed to practice law by the North Carolina State Bar and one year of professional legal experience.

Nice To Haves

  • 2-5 years of progressive civil litigation experience preferred.
  • Experience in trial courts preferred.
  • Jury trial experience preferred, but not required.
  • Legal research and writing experience preferred.

Responsibilities

  • Represents DAC and its employees in Litigation. This position will draft motions to dismiss and answers to complaints in federal and state court. In order to do so, the attorney in this position will need to investigate the accuracy of the allegations by collecting, critically reviewing, and analyzing the information and documents provided by DAC and the defendants
  • This position will be responsible for filing motions for summary judgment, in appropriate cases. This will include the drafting of memoranda of law in support of motions for summary judgment, accompanied by the necessary supporting record evidence, such as affidavits and exhibits.
  • This position will be responsible for responding to written discovery requests, including interrogatories, request for production, and requests for admission. This will require the attorney to gather, organize, and review witness statements, prison records, medical records, and other information made available by DAC or other entities.
  • This position will be responsible for defending cases through trial, most often a jury trial in federal court.
