The work we do matters! Hiring Agency: Military - Agency 31 Location: Lincoln, NE. We're seeking an Attorney who excels at legal research, clear writing and interpreting complex laws. The ideal candidate can quickly analyze information, communicate findings clearly and adapt to shifting priorities. The position is located at the Nebraska Emergency Management Agency, 2433 NW 24th Street, Lincoln NE. If the Attorney II level cannot be filled, applicants at the Attorney I level will be considered, with potential for promotion to Attorney II after a successful probationary period and completion of requirements and trainings within one year, when performing higher level duties.

Requirements

  • One year of experience as an attorney practicing law and providing legal services such as preparing cases, advising clients, and/or interpreting laws or administrative policies (for Attorney II).
  • Background/motor vehicle request checks will be required prior to hire.
  • Must have a valid driver's license.
  • Within one year of employment successfully complete FEMA IS courses: IS-00120.c, An Introduction to Exercises; IS-00139.a, Exercise Design and Development; IS-00200.c, Basic Incident Command System for Initial Response; IS-00230.e, Fundamentals of Emergency Management; IS-00235.c, Emergency Planning; IS-00240.c, Leadership and Influence; IS-00241.c, Decision Making and Problem Solving; IS-00244.b, Developing and Managing Volunteers; IS-00700.b, An Introduction to the National Incident Management System; IS-00703.b, National Incident Management System Resource Management; IS-00800.d, National Response Framework, An Introduction; IS-01300, Introduction to Continuity of Operations; IS-02200, Basic Emergency Operations Center Functions.
  • In accordance with Section 7-101, Nebraska Revised, Reissued Statutes of l943, incumbents in this class must be admitted to the Nebraska Bar.
  • Knowledge of the techniques of preparing/drafting legal documents and forms.
  • Knowledge of the principles and practices of criminal and civil law administration.
  • Knowledge of judicial procedures and rules of evidence.
  • Knowledge of the principles and practices of legal research.
  • Knowledge of the procedures of trial and administrative hearings.
  • Skill in preparing summaries, legal analyses, findings, conclusions, briefs, and other legal documents.
  • Skill in negotiating and communicating with others sufficient to persuade their acceptance of contentious goals or viewpoints.
  • Ability to prepare and communicate in person and by telephone, emails, summaries, and correspondence, the facts and arguments of a case to persuade others to accept the viewpoint presented.
  • Ability to interact with legal associates, other government employees, the public, and representatives of parties involved in a case.
  • Ability to formulate legal opinions and recommendations based on legal research and investigations.
  • Ability to conduct legal research and investigations.
  • Ability to prepare drafts of legal documents and forms.
  • Ability to identify critical elements of legal questions or issues and select appropriate course of action.
  • Ability to interpret and apply statutes, case law, decisions of judicial and administrative hearings, and administrative rules and policies.

Nice To Haves

  • Graduation from an accredited school of law and admission to the Nebraska Bar (for Attorney I, considered if Attorney II cannot be filled).

Responsibilities

  • Confers with legal associates, agency staff, local government officials, and other interested parties to exchange and prepare information on the facts and status on legal and/or administrative actions or issues.
  • Research legal precedents, case reports, and other legal documents to collect information for case preparation to facilitate the administration and enforcement requirements and needs of the agency.
  • Guides technical support and/or legal staff in the legal practices and regulations of the agency to assist in the development of a competent, professional staff.
  • Prepares legal documents for use by the Attorney General and/or County Attorneys’ offices in prosecuting civil or criminal cases.
  • Presents information or testimony at public meetings or judicial or legislative hearings to provide and explain legal and policy information.
  • Interprets provisions and advises agency staff and interested parties outside the agency regarding court decisions, administrative rules, and other legal statements to respond to inquiries form them to ensure adherence and compliance by agency staff.
  • Drafts and analyzes proposed legislation, agency policies, and procedural statements to provide agency management with legal opinions and options.
  • Represents the agency in administrative hearings related to the enforcement of federal and state statutes and/or administrative rules pertaining to the Agency.
  • Lead strategy for risk assessment, compliance, and monitoring as necessary to comply with provisions of the Nebraska Emergency Management Act, Robert T. Stafford Disaster Relief and Emergency Assistance Act (Stafford Act), Title 2 and Title 44 of the Code of Federal Regulations and other relevant state and federal laws.
  • Research and prepare drafts of Governor’s emergency proclamations, executive orders, and other official documents related to emergency declarations.
  • Research and prepare Memorandums of Understanding, Memorandums of Agreement, contracts by and between the Agency, other state agencies, other political subdivisions, and federal entities.
  • Represent the Agency on the National Emergency Management Association Legal Liaison Committee.
  • Represent the Governor/Agency in field deployments as the State liaison.
