About The Position

DCAMM is looking for an attorney to join DCAMM's Office of the General Counsel (OGC). This team member will provide the highest quality legal advice to OGC to enable it to efficiently perform its statutory functions. This position seeks an experienced commercial real estate attorney for sophisticated multi-party complex transactions, including acquisition and disposition of Commonwealth real property, permitting and licensing and the certification of eligible contractors to perform work on public projects. This enables OGC to perform a critical and active role in developing and implementing DCAMM’s policies with respect to all real estate, construction, certification and associated actions. The Counsel III will be expected to draft high-quality agreements, memoranda, reports and other documents, and to negotiate the same in the best interest of the Commonwealth; work closely with members of DCAMM’s senior staff to ensure that all actions of DCAMM are authorized by applicable laws, regulations and guidelines; respond to legislative and public requests and prepare briefings and other analyses; interact with appointed officials in the executive branch; be responsible for staying abreast of rapidly evolving legal issues, precedents, rulings and statutes impacting DCAMM’s operations; and follow a hybrid work model that consists of both in-office and work from home days.

Requirements

  • Applicants must have a Juris Doctor (JD) degree
  • Admission to the Massachusetts Bar Association
  • At least (A) six years of full-time, or equivalent part time, professional experience in the practice of law in a specialized area that is relevant to the assigned agency.
  • Based on assignment and supervisory responsibilities, three years in a supervisory capacity may be required.
  • Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.

Nice To Haves

  • Experience in commercial real estate law (not residential) - 7 - 12 years preferred
  • Experience working on complex real estate transactions, including drafting and negotiations
  • Experience working on complex leasing deals and negotiations

  • State and municipal permitting experience
  • Demonstrated ability to coordinate the efforts of others under tight time constraints
  • Knowledge of state laws and regulations
  • Thorough knowledge of the principles and practices involving negotiations
  • Excellent oral and written communication skills

Responsibilities

  • Provide legal advice, engage in negotiations and draft documents associated with a high volume of complex, commercial real estate acquisition and disposition transactions, which may include resolving title matters and deed restrictions.
  • Provide legal advice, engage in negotiations, advise on deal structure and draft documents for the Public-Private Partnership team associated with the complex redevelopment of state assets (state office buildings, higher education campuses, health and human services campuses, etc.).
  • Provide legal advice and draft documents associated with the procurement, amendment and resolution of disputes regarding the lease of space for the use of user agencies within the Commonwealth.
  • Undertake legal research and prepare memoranda and other materials.
  • Work on public presentations, attend public hearings and meet and coordinate with other agencies and appointed and elected officials across Massachusetts.
  • Assist the General Counsel in providing strategic and overall management for all DCAMM projects.
  • Respond to inquiries from municipal and elected officials and the executive branch (including the Governor’s Office).
  • Demonstrate the ability to work as a team member that may include members of other departments and outside agencies and municipal and state officials.
  • Perform such other duties as may be required to assist the General Counsel and/or Deputy General Counsels.
