Requirements

  • Position based in New York City
  • 5-7 years of experience; in-house experience preferred
  • Member of the New York State bar
  • General knowledge of US and international trademark law, policies, and processes
  • Global experience
  • Ability to form strong, collaborative relationships with business leaders and serve as a counterpart to the Marketing & Creative Operation teams
  • Ability to execute in a fast-paced, complex matrixed environment

Responsibilities

  • Work closely with senior trademark counsel to provide legal advice on all aspects of trademark and copyright law
  • Review and analyze trademark search reports
  • Prepare memoranda to clients regarding availability of proposed marks
  • Review trademark watch notices
  • Work with senior members of Legal Trademark team on negotiation and drafting of license, co-existence and settlement agreements
  • Own U.S. prosecution of trademark applications across all ELC brands, including substantive responses to Office Actions or Prepare substantive responses to Office Actions across all ELC brands
  • Manage domain name disputes
  • Support the company's anti-counterfeiting efforts including online enforcement, managing civil and administrative cases and providing support and direction to partners who work directly with customs, police and other law enforcement and government agencies
  • Advise clients on proper usage of trademarks, including potential risks and issues
  • Manage outside counsel in connection with conflict matters
  • Advise and consult with clients at all levels of the organization, including senior leadership, to identify critical legal issues, assess potential legal options, and provide individuals and teams with an analysis and range of possible legal solutions, all in the areas of trademark and copyright law
  • Exercise independent judgment related to company legal matters
