About The Position

The United States Attorney's Office (USAO), Southern District of Florida (SDFL) is seeking an experienced attorney to handle litigation in Bankruptcy Courts in the Southern District of Florida. If selected, you will be working with a team consisting of another full time Bankruptcy AUSA and two full time Bankruptcy paralegals to practice before all federal bankruptcy courts in this District. The cases you will handle consist of creditor side bankruptcy representation of other federal agencies, such as the Internal Revenue Service, the Small Business Administration and the Department of Education, in Chapter 7, 11 and 13 proceedings under the United States Bankruptcy Code, and related adversary proceedings. You will be assigned cases to litigate from inception to completion as the sole attorney representing those federal agencies in bankruptcy court, to preserve said agencies' claims to payment from the bankruptcy estate. Your responsibilities will increase and become more complex as your training and experience progress. Position Requirements: Applicants must possess excellent academic and professional credentials, superior oral and written communication abilities, outstanding legal research and analytical skills, and have a J.D. from an accredited law school. A minimum of two years of creditor side bankruptcy experience or two years post law school clerkship experience with a federal Bankruptcy Judge (or combination thereof) is required. Applicants must be an active member of a state bar in good standing. Security Requirements: Initial appointment is conditioned upon a satisfactory preemployment adjudication. This includes fingerprint, credit and tax checks, and drug testing. In addition, continued employment is subject to a favorable adjudication of a background investigation. Residency Requirements: Assistant United States Attorneys generally must reside in the district to which he or she is appointed or within 25 miles thereof. Selective Service: If you are a male applicant born after December 31, 1959, you must certify that you have registered with the Selective Service System, or are exempt from having to do so under the Selective Service Law.
