Under the direction of the General Counsel and Deputy General Counsel, the Assistant General Counsel is responsible for providing legal advice, liability prevention strategies, and risk management services for the NC State Bureau of Investigation (SBI). The Assistant General Counsel renders legal advice regarding highly complex statutes, constitutional issues, and unique issues without legal precedent. Key responsibilities include but are not limited to: Understanding and anticipating legal issues with significant and complex legal implications to the SBI and the public and counsels accordingly. Using legal expertise to analyze new laws and court decisions in order to communicate how the new laws and decisions will impact the SBI. Drafting and and reviewing complex documents and calculating short-term and long-term legal impact of documents upon the agency and the state. Drafting and reviewing policies and procedures for the SBI's divisions. Assisting with obtaining court orders for electronic surveillance. This assistance includes reviewing affidavits, drafting applications and orders, and coordination with the Administrative Office of the Courts, court personnel, and judges. Monitoring pending litigation involving the SBI by analyzing the strengths and weaknesses of cases to develop and execute an effective litigation strategy and arguments to achieve the agency's desired result. Providing legal advice to executive management and senior managers on the merits of litigation, settlement, and appeal and provides technical assistance to the Attorney General's office. Serving as an on-call legal advisor for SBI Agents in the field. Providing legal representation for the component parts and functions of the SBI and, in particular, the Criminal Information and Identification Section (CIIS). Rendering legal advice regarding highly complex sex offender registry and concealed handgun statutes; reviews and provides legal opinions on expunction requests and orders regarding the NC Sex Offender Registry. Assisting with providing and overseeing specialized training on constitutional law, arrest, and search and seizure for the SBI and in reviewing uses of force, internal affairs investigations, and other high liability incidents.
