About The Position

The Assistant City Attorney III, Water or Senior Assistant City Attorney, Water provides legal counsel to the City of Loveland on water law issues, primarily representing the Water Division of the City's Water & Power Department. This role involves legal research, contract writing and review, advising on water acquisition, and strategizing on civil and water court litigation. The attorney will draft ordinances, prepare legal documents, and provide legal advice on various municipal law matters, ensuring the protection of the City's water resources.

Requirements

  • Law degree from an ABA-accredited U.S. law school.
  • 6 years of experience in general municipal law and/or related areas, including 4 years in water law for Assistant City Attorney III.
  • 7 years of experience in general municipal law and/or related areas, including 5 years in water law for Senior Assistant City Attorney.
  • Valid driver's license preferred.
  • Must be licensed to practice law in Colorado and in good standing with the Colorado Supreme Court.

Responsibilities

  • Perform legal work in all phases of water law.
  • Write coherent and concise legal pleadings, opinions, briefs, municipal legislation, correspondence, and memoranda of law.
  • Address legal issues arising from routine water, wastewater, and sewer operations, as well as capital projects.
  • Handle legal matters associated with utility easements, utility location and conflicts, and compliance with utility construction standards.
  • Draft intergovernmental agreements for water interconnections, substation maintenance, mutual aid, and water quality studies.
  • Provide legal advice on development-related matters, including oversizing agreements and water rights matters.
  • Attend City Council meetings and City management team meetings as needed.
  • Assist in training of other attorneys and office support staff.
  • Interpret federal, state, and local laws, rulings, and regulations.
  • Prepare contracts, ordinances, resolutions, and other legal documents.
  • Review City contracts and other legal documents for legal sufficiency and implications.
  • Identify potential legal issues raised by City policies and practices and recommend actions to address them.
  • Represent the City in negotiations and in administrative and court proceedings.
  • Perform legal research and write briefs, memoranda, and opinions of law for various City entities.
  • Keep the City Attorney informed of matters being handled as required.
  • Attend meetings of boards and commissions as assigned.
  • Work independently with minimal supervision.
  • Perform other duties as assigned.
