The Adjudication Officer for Independent Dispute Resolutions (IDR) in Long Term Care serves as a neutral and unbiased administrative hearing officer for facilities contesting state or federal regulatory citations and survey deficiencies. The officer upholds due process through comprehensive review and analysis of the administrative record, including clinical documentation, investigative summaries, surveyor findings, facility statements, and written or verbal testimony from residents, families, or legal representatives when provided. Hearings are conducted in a fair, structured, and less formal environment than court, supporting transparency while maintaining the integrity of regulatory oversight and resident safety standards. Following each hearing, the officer issues timely written findings and determinations, including a clear recommendation for an Agency decision (to uphold, modify, or dismiss a citation) and a concise, well-supported rationale aligned with regulatory and evidentiary requirements. When adjudication activity is not in session, the officer provides direct support to the Long Term Care policy team, including: · Regulatory research and analysis on federal and state best practices, · Regulatory development support, including drafting and revision of policy guidance or regulatory language, · Development of proposed legislation to enhance the Agency’s ability to fairly and responsibly license and certify long term care facilities in the Commonwealth, · Review of and preparation of comments on introduced legislation which impacts the Agency’s licensure and certification of long term care facilities, · Inspection and compliance trend research, · Regulatory framework comparisons, and · Policy planning and written product support to improve clarity, consistency, and system performance. This position focuses on regulatory compliance outcomes, not contractual or payment disputes. The officer’s work influences facility compliance expectations, enforcement outcomes, and ongoing adherence to Medicare and Medicaid certification standards. The role strengthens fair process, consistent policy application, and resident safety, while supporting modernization of Long Term Care oversight through policy development, regulatory strategy, and evidence-based system improvements.
