About the position

The University General Counsel serves as the chief legal advisor to Fairmont State University, providing expert legal guidance on a wide range of issues affecting the institution. This role involves overseeing the university's legal affairs, managing litigation, ensuring compliance with laws, and advising senior leadership. The General Counsel collaborates with various departments and the Board of Governors to support the university's mission and strategic goals.

Responsibilities

  • Provide expert legal advice to the University President, Board of Governors, senior leadership, and university departments on various legal issues including contracts, employment, student affairs, governance, and regulatory compliance.
  • Interpret and advise on federal, state, and local laws, regulations, and policies affecting the university.
  • Oversee and manage all university litigation and disputes, including working with external counsel as needed.
  • Develop and implement strategies for resolving legal disputes and mitigating risks.
  • Prepare reports regarding ongoing litigation matters to the Board of Governors.
  • Ensure the university's compliance with applicable laws, regulations, and internal policies.
  • Develop and implement policies and procedures to manage legal risks and ensure legal compliance.
  • Review, draft, and negotiate contracts, agreements, and other legal documents.
  • Provide guidance on legal terms and conditions to protect the university's interests.
  • Assist in the development, review, and implementation of university policies and procedures.
  • Ensure university policies are legally sound and up-to-date with current laws and regulations.
  • Advise the Board of Governors and various university committees on legal matters.
  • Attend board meetings and provide legal guidance on agenda items.
  • Provide updates to the board on legal matters involving the university.
  • Serve as ex-officio member of the By-Laws Committee to the Board of Governors.

Requirements

  • A Juris Doctor (JD) degree from an American Bar Association (ABA) accredited law school is required.
  • Admission to the bar in the state of West Virginia.
  • Minimum of 7-10 years of experience in legal practice, with a significant portion in higher education law or related fields.
  • Strong knowledge of higher education law, employment law, student affairs, and compliance issues.
  • Excellent legal research, writing, and analytical skills.
  • Proven ability to manage complex legal issues and provide strategic legal counsel.
  • Strong interpersonal and communication skills, with the ability to work effectively with diverse stakeholders.
  • Demonstrated ability to handle confidential and sensitive information with discretion.

  • Ability to work independently and collaboratively.
