About the position

Under the general direction of the Deputy Director of the Enforcement Division of the California Privacy Protection Agency ("Agency" or "CPPA") or their designee, the Attorney IV is responsible for prosecuting violations of the California Consumer Privacy Act (CCPA) in administrative enforcement actions that involve novel theories, emerging areas of law, legal specialization, and precedential significance. The Attorney IV will serve as an experienced attorney performing the most complex and sensitive legal work. The Attorney IV investigates violations of the CCPA in the most complex matters, reviews consumer complaints and other leads, gathers and analyzes facts in the most complicated cases, evaluates novel legal arguments and defenses, conducts probable cause hearings that raise novel or significant legal issues, drafts administrative pleadings, and presents precedent-setting legal arguments to probable-cause hearing officers, administrative law judges, and the CPPA Board. The Attorney IV engages in all aspects of administrative enforcement actions regarding the CCPA, including discovery, motion practice, settlement negotiations with opposing counsel, hearings, legal research, brief drafting, and responses to challenging legal correspondence. The Attorney IV develops strategy and tactics in complex disputes or litigation, collaborates with the Enforcement Division's staff, and serves as lead counsel on projects. The Attorney IV also collaborates with the CA Attorney General's office and government agencies in other jurisdictions.

Responsibilities

  • Prosecute violations of the California Consumer Privacy Act (CCPA) in administrative enforcement actions.
  • Investigate violations of the CCPA in complex matters.
  • Review consumer complaints and other leads.
  • Gather and analyze facts in complicated cases.
  • Evaluate novel legal arguments and defenses.
  • Conduct probable cause hearings.

  • Present legal arguments to hearing officers and judges.
  • Engage in discovery, motion practice, and settlement negotiations.
  • Collaborate with the Enforcement Division's staff and other government agencies.

Requirements

  • At least 3 years of post-J.D. litigation experience.
  • Experience with motion practice, discovery, trial, settlement negotiations, and appeals.
  • Experience conducting government investigations and partnering with law enforcement.
  • Strong ability to analyze complex legal and factual issues.
  • Excellent written and oral communication skills.
  • Strong organizational and analytical skills.

Nice-to-haves

  • Experience with the California Administrative Procedure Act.
  • Experience responding to government investigations or conducting corporate internal investigations.
